Business and Investment Visas

(Provisional) visa for business innovation and investment (Subclass 188)
The Business Innovation and Investment Program includes the Business Innovation and Investment (Provisional) visa (subclass 188).
Before being invited to apply for this visa, you must submit an Expression of Interest (EOI) through SkillSelect and be nominated by a state or territory government or Austrade on behalf of the Australian government.

The visa includes five streams :

Business Innovation Stream
Investor Stream
Significant Investor Stream
Premium Investor Stream
Entreprenuer Stream

The first step toward becoming eligible for a Business Innovation and Investment (Permanent) visa is to get this visa (subclass 888).

  • To apply for this visa, you must first submit an Expression of Interest (EOI), after which you will be invited to apply through SkillSelect.
  • Before being invited to apply, you may be nominated.
  • Your EOI must say the stream you plan to apply for and which state or territory you want to be nominated by, as well as whether you want to be nominated by the Australian government (where possible).

Business Innovation and Investment (Permanent) visa (subclass 888)

The second stage of the Business Innovation and Investment (Provisional) visa is the Business Innovation and Investment (Permanent) visa (subclass 888). (subclass 188). After you’ve met the requirements of your provisional visa, you can apply for it. To apply for this visa, you do not need to submit a fresh Expression of Interest or wait to be invited. If you want to meet the primary requirements, you must be nominated by a state or territory government agency or Austrade on behalf of the Australian government.If you have a provisional Business Innovation and Investment visa (subclass 188) in your possession, you must show proof that the government entity that nominated you for the visa has not withdrawn the nomination.
If you have a Special Category visa (subclass 444) or need nomination from someone other than your provisional Business Innovation and Investment visa (subclass 188) nominator, you must first obtain nomination from a state or territory or Austrade on behalf of the Australian government before applying for this visa.

Subclass 888

You can manage your business and investments in Australia using the Business Innovation and Investment (Permanent) visa (subclass 888).
This is a visa that allows you to stay in the country indefinitely. It allows you and any family members who have been granted this visa to travel together.
Stay in Australia indefinitely, work and study in Australia, enrol in Medicare, Australia’s health-care and expenses scheme, apply for Australian citizenship (if eligible), sponsor eligible relatives for permanent residence, and travel to and from Australia for five years from the date the visa is granted (after that, you’ll need a resident return visa or another visa to return to Australia).

Subclass 888 - Business Innovation Visa - Residency requirements

Applicants for Subclass 888 visas must normally have spent at least one year in Australia in the two years preceding their application.
If the applicant held one of the following visas throughout the COVID concession period, which began on 1 February 2020, time spent overseas could be recorded as time spent in Australia:
  • Business Innovation and Investment (Provisional) visa (subclass 188) Business Innovation stream
  • Business Innovation and Investment (Provisional) visa (subclass 188) Business Innovation Extension stream

Subclass 887 - Skilled Regional Visas - Onshore /offshore concessions

Applicants outside Australia

During the COVID concession period, which begins on February 1, 2020, eligible applicants must apply for a visa outside of Australia and be granted the visa while outside of Australia.

During the concession period, these candidates will also be eligible for the following reduced employment and residency requirements:

9 months of full-time employment in a designated geographic area.
A 3-month reduction in the ordinary 12-month period (or, if the Minister specifies a shorter period in a legislative instrument, that shorter period), as well as 18 months of residence in a designated regional area.
A six-month reduction in the regular two-year timeframe (or, if the Minister specifies a shorter period in a legislative instrument, that shorter period).

Business Talent (Permanent) visa (subclass 132)

The Business Talent visa (subclass 132) is a permanent residence visa for business individuals who have been nominated by a government agency in an Australian state or territory.
To apply for this visa, you must first submit an Expression of Interest (EOI) through SkillSelect, after which you will be asked to apply.
When you apply for a visa and the decision is made, you can be in or out of Australia.

Subclass 132 Visa

The Business Talent visa (subclass 132) permits you to start a new business in Australia or expand an existing one.This is a visa that allows you to stay in the country indefinitely. It allows you and any family members who have been granted this visa to do the following:
l Indefinite stay in Australia
l In Australia, you can work and study.
l Enroll in Medicare, Australia’s health-care and expense-reimbursement program.
l seek for citizenship in Australia (if you are eligible)
l Relatives who are eligible for permanent residency can be sponsored.
l You can travel to and from Australia for five years from the date the visa is granted (after that, you’ll need a resident return visa or another visa to return).

Subclass 132 Application

To apply for this visa, you must first submit an Expression of Interest (EOI), after which you will be invited to apply through SkillSelect.
Your indication of interest must include the following information:
  • Which stream do you want to apply for?
  • whether you want to do business in simply one or more Australian states and territories
  • After you’ve filed your expression of interest, the government of your state or territory may review it and determine whether or not to nominate you to apply for the visa.
  • The parameters used by state and territory governments to choose who to nominate are different. Before you are nominated, the authority may contact you to discuss business opportunities. In some cases, the authority will not contact you until you do.
